The emergence of the genre of crime story in modern mass media has attracted scholarly attention in relation to the literary influence of the Western detective story in modern Korean literature. By and large, it has been misread as an adaptation of modern European culture. However, such analysis centered on modern literary discourse has completely overlooked the fact that these crime stories in modern newspapers were closely linked to Confucian discourse and Korean legal tradition, in which popular crime stories were produced and circulated as a genre of Korean legal literature rather than as popular fiction. On the other hand, in a paradoxical way, those crime stories were strikingly modern in expressing uneasy and complex emotions towards traditional law and society and distancing themselves from traditional legal literature in which social criticism was overshadowed by Confucian conservatism. This paper examines how the popular perception of law and justice was transformed during the transitional period and how the people perceived the gap between Confucian values and the newly adopted modern judicial system by taking a closer look at crime reports and popular crime stories such as the Sindan gongan or Celebrated Court Case Stories (1906) serialized in modern Korean newspapers. These seemingly “mediocre” crime stories, however, deserve our attention in that they shed light on the conflicting and entangled relationship between tradition and modernity, which was nearly impossible to sever in cultural practice in the modern times.
