This report studies the problems and legislation improvement of Consumer Anti-Discrimination Laws. Anti-discrimination laws refer to the laws on the right of consumer to be treated equally in consumer transactions.
Governments should regulate Consumer Anti-Discrimination through laws. The current Anti-Discrimination Laws in Korea are a separate legislative system. The typical Laws on Anti-Discrimination are The Constitution, National Human Rights Commission Act, Anti-Discrimination against and Remedies for Persons with Disabilities Act and so on. But there are no legal articles about anti discrimination in consumer laws; Framework Act On Consumers, Civil Act, Regulation Of Standardized Contracts Act, Electronic Financial Contract Act and so on.
Recently, in order to solve the problem of separate legislative system, developed states is proposed the integrated legislative system. Consumer Protection Act of Republic of South Africa, Consumer Rights Protection Act of the Republic of Latvia and EU Draft Common Frame of Reference (DCFR) are provided an integrated consumer laws. They gain efficiency and effectiveness of Consumer Anti-Discrimination Laws.
This report intended to present a suitable alternative for the present with the normative analysis, the legislative analysis on Consumer Anti-Discrimination Laws. The object of this report proposes alternatives about the improvement legislation of Consumer Anti-Discrimination Laws with performing the retrospective evaluation in Consumer Anti-Discrimination Laws. I hope that these alternatives will be utilized as the useful legislative materials to enacting Consumer Anti-Discrimination Laws in the future.
