The Criminal Procedure law is a procedural. Thus, It has a dynamic and evolutionary personality. The Criminal Procedure Law of the Anglo-American or Strafprozeβrecht and Strafverfahrensrecht for for The Criminal Procedure Law are same concept.
Nevertheless, The lawsuit seems to not have a precise understand about this until now. The original lawsuit says it of the trial procedure. But Code of Criminal Procedure, Trial procedures, as well as the investigation procedures are also included. This is the reason that caused confusion on the understanding of the lawsuit.
If you see a narrow sense, the lawsuit, the theory in general lawsuit can not be applied for all procedures. If you see a broad sense, the theory of the conduct of the investigation agency is also included and can be applied for all procedures. The difference of these results according to the understanding of the lawsuit will have a significant impact in our understanding of the system.
With the meaning of the original lawsuit, in this article we explore the concept of reasonable lawsuit in criminal proceedings. And examine whether it is appropriate to describe how the textbook for a systematic understanding.
Such understanding, however, because it does not match the concept of lawsuits and disciplinary range of the Code of Criminal Procedure, absolutely right you will not be able to.
