Most of the cases of constitutional problems are the cases on the limitation of individual rights The solution to these constitutional problems is not very much different at all Therefore, it is important to understand the basic study method of the cases on the limitation of individual rights
First of all, we have to clarify what type of the limitation it is Does the statute violate an individual right? Does the citizen require the state action as an individual right? Dose the state action violate an individual right? Does the case violate the equal protection clause caused by discrimination? Does this case ask about the procedure of relief of an individual right?
Next, when we investigate the case on the limitation of individual right, we should examine the following solutions First, we have to figure out the reason and legal background o the case Second, we should find out the main violator(state or private person) and search the relief procedure of the right accordingly
Third, we have to find the specific solution by examining the meaning and characteristics of individual rights, the scope of the limitation, the sampling of the content of individual right, etc Also we have to provide the solutions considering the exceptions in the following cases, ie, in the cases of equal protection clause, the freedom of vocation and the property right
