China"s economy has now become the second in the world, and the trade scale has risen to the top three. Recently, Sino-Korean trade increased rapidly. Since 2002, China has become the largest export market of South Korea, and the largest trading nation. For the purpose of the sustained and healthy development of Sino-Korea trade and the strengthening of consumer sovereignty, this study aims to offer a better mutual understanding for the consumer protection legal systems between the two countries.
This paper is to make a research in the basic laws and related consumer protection laws of South Korea and China. Chiefly through comparing the laws concerning visit selling, direct selling and reselling which consumer losses often occur. This paper hopes to make a comparison between South Korea and China according to the existing relevant legal systems on consumer protection. Collecting related documents and a variety of associated journals on consumer protection from the year 2000 to 2008 in the two countries, then analyzing the academic materials, this paper reaches the following conclusions:
First, the consumer protection agency of South Korea is a government based organization, but those of China are half government and half private based organization.
Second, their approaches of handling disputes are different. China doesn"t have the special committee(as Consumer Dispute Settlement Commission in Korea) which has a legal power.
Third, Pyramid Selling, not uni-level selling, is illegal in China. So allowance by a multilevel distributor to a multilevel sales person is also illegal.
Fourth, but Korea Door-to-Door Selling, etc. Act regulates a withdrawal of an offer of contract, China has no. China has only return-goods.
