Seventh revisions of Incoterms 2000, namely Incoterms 2010(4th draft, final draft)with an effectiveness of Jan. 1, 2011 have finally drafted, but we can not yet come to hand because of ICC’s sale business prior to distribution to world wide.
This thesis placed on the focus Incoterms 2010(3rd draft). As we know, Incoterms are rules about the responsibilities of the buyer and seller for delivery of goods under sales contracts. Incoterms 2010(4th draft) consist of 11 Incoterms into two new classification, namely EXW, FCA, CPT, CIP, DAP, DAT, DDP as terms for any mode of transport and FAS, FOB, CFR, CIF as maritime-only terms. But according to 3rd draft, DEQ added as maritime- only terms instead of DAT for any mode transport.
A new Incoterms 2010 has many special character in the aspects of change of a new classification system and distinguishment between obligations, new improvement of regulations in comparison with Incoterms 2000. In spite of that, Incoterms 2010 has also many problems from a point of view in expression of regulations, undistinguished COD and CAD, disfigurement between DEQ and DAP.
This problems must be revised through Incoterms 2020 after 10 years.
