This paper deals with a practical case which contians some important constitutional issues-unconstitutionality of the Adultery Clause, freedom of occupation, principle of proportionality, equal protection, legislative facts, unconstitutionality in application, etc. A CPA(Certified Public Accountant) was sentenced to 1 year in prison with a 2-year suspended sentence for the Adultery, Article 241 of the Criminal Act at the trial court, and that was uphold by the Supreme Court. As a result of that judgement, he is subject to be cancelled his CPA license, furthermore he shall not be able to be occupied in the CPA service. It is caused by CPA Act provision: in the case of that Any CPA is sentenced to be in prison(including its suspension), he shall be cancelled and disqualified for his CPA license during suspension period(in this case 2-year) and 2 years after the termination of the suspension.
Here comes the brief conclusion of this paper.
(ⅰ) Article 241 of the Criminal Act which prohibits adultery shall be ruled ⅰ unconstitutional as a violation of the principle against excessive restriction because it provides incarceration as the only form of punishment without allowing more moderate forms of penalty, for instance, fine.
(ⅱ) The CPA Act provisions which provide cancellation of license and disqualification shall be ruled unconstitutional as a violation of the principle of proportionality because of the respect that if any CPA is sentenced to be in prison (including its suspension) regardless of the sort of crime, he is supposed to be cancelled and disqualified for his CPA license during a fixed period.
(ⅲ) Above-mentioned CPA Act provisions have not rational reason for justifying discrimination in comparison with a doctor, a pharmacist, and a Customs broker who shall be cancelled and disqualified for their licenses only when they are sentenced to be in prison for committing job-related crimes. On top of that, the CPA Act provisions don't have strictly proportional relationship between the object of discrimination and the means for achieving the object.
(ⅳ) In the litigious perspective, Nation(Legislators) shall demonstrate that above-mentioned restriction is effective for securing the integrity of and people's reliance to the CPA's duty.
(ⅴ) In this case, although the CPA's marrige came to actual rupture, he had to be sentenced to in prison (including its suspension), as a result, authority-concerned has to necessarily cancel his license. Thus, it is desirable for the Constitutional Court to rule that “the cancellation and disqualification provisions of the CPA Act are unconstitutional, when applied to this applicant.”
