Democratic government is not possible without fair and honest election procedures. There have been many impediments to the realization of genuine democracy in Korea. Korean citizens are cynical about the possibility of a genuinely democratic government and apathetic regarding the election process. The citizens' apathy has encouraged political candidates to assume that violations of election laws will be overlooked or even tolerated when they are uncovered, thereby adding to the citizens' distrust of politics and politicians and their disdain for government institutions.
History is filled with examples. The Law on Public Election and Prevention of Illegal Elections enacted in 1994 was designed to guarantee clean and fair elections. Although many Koreans expected this law to achieve its goals, illegal and corrupt practices have persisted and a "culture of corruption" remains in place. Political unfairness during the investigatory, prosecutorial and trial processes abound and include trial delays, unwarranted clemency, and minor penalties that are incommensurate with the costs to the public of illegal acts by corrupt politicians who profit from their greed.
The authors have identified promising remedial measures to improve the election process. Priority should be placed on establishing fair and impartial judiciary procedures. Judges must be objective and follow the rule of law. They should cooperate in developing a uniform approach to dealing with violations of election laws and precedents that will guide each judge in handling assigned cases without bias or favoritism toward any of the contestants during trials. Additionally, trials should begin promptly and within a maximum of one year. Defendants should no longer be granted delays so that they can continue participating in the deliberations of the National Assembly or so that they can remain at home because of illnesses that are not life threatening or genuinely severe. A uniform trial schedule should be established for all courts and all trials should begin promptly and continue without unwarranted interruptions every day until the trial ends.
To avoid severe, and possibly disastrous civil disorder, we must adhere to existing election laws and ensure fair and clean elections that will restore the confidence of the people in their government.
