We think that we are held equal before the law. This means that the state cannot treat us as inferior or superior to any other person in society. When the letter of the law goes together with the spirit of the law there will be few conflicts in our society.
Why do we often come into conflict with each other? Hsun Tzu says that human nature is originally evil and his goodness is acquired by training. Hsun Tzu thinks that what is good and valuable is the product of human effort as culture. Shakespeare sees human beings as actors on the stage of the world because they cannot be described as a distinctive nature. But he values social order and stability. He tries to show this social stability as culture in his plays. By culture mean Hsun Tzu and Shakespeare that we obey the law and the standard of law is provided by nature.
Shakespeare shows that mercy is needed in the application of law because the strict justice of law can do worse injustice than not applying it at all. Hsun Tzu says that the li regulates men's desires and purifies men's emotions. The mercy of Shakespeare and the li of Hsun Tzu are embedded in nature, and they can work as a measure of law for social harmony and peace. Their emphasis on social control comes from naturalism. They think that human beings obey the natural law as the ultimate order of the universe. But nature always changes and there are no absolute values in the world. Thus we need the very natural order that we transcend.
Hsun Tzu and Shakespeare believe that nature presents us with the musical principle of harmony. Music functions as guidance for men's minds of good and evil. This is the Confucian view of music. Confucius tried to educate people on music and the li. But he himself knew that his teachings would not be effective as he hoped. This is the same dilemma as Hsun Tzu and Shakespeare are facing. That is why we still fall back on their view of the measure of law based on musical harmony.
