Transparency has been an important principle for GATT/WTO since its founding, because it strengthens predictability of trade policies, which helps reduce costs of traders. In the trade facilitation negotiations in the Doha Development Agenda, WTO member countries are seeking to install stronger transparency measures for trade related laws and regulations.
In the last few years, OECD, in its research on regulatory reform, has emphasized the concept of 'regulatory transparency.' OECD operationally defines regulatory transparency as the capacity of regulated entities to express views on, identify and understand their obligations under the law. Thus, 'regulatory transparency' goes beyond the traditional 'informational transparency.' This paper examines the transparency measures of GATT and various DR Agreements in the context of regulatory transparency. The paper finds that, compared to GATT, transparency measures have been strengthened in the DR Agreements, and the DR Agreements include various measures which strengthen regulatory transparency.
In this context, measures which have been proposed in the WTO trade facilitation negotiations should be seen as a natural outgrowth of regulatory transparency measures already widely incorporated in the UR Agreements. The paper concludes by suggesting that, while some Members are concerned that some transparency measures proposed in the trade facilitation negotiations give too much power to foreign traders (who are the regulated party), the concern is unfounded, since similar measures are already in place throughout various UR Agreements.
