This article is to analyse the Chinese case law, Dresdner Bank Shanghai Branch v. Shenzhen Zhong Dian Investment Co. Ltd., whose disputes caused by transferring bank's mistaken action, omitting one of documents stipulated in the original credit in issuing the transferred credit in order to evaluate the reasonableness of the court's judgement.
In this case, at the request of 1st beneficiary, transferring bank effected a transfer of the credit but committed a document issued by Metro Dusseldorf, that was required to be presented along with other required shipping documents in the transferred credit. As a result, the 2nd beneficiary could not have the chance to prepare the document as required in the original credit. The issuing bank rejected the documents received from 2nd beneficiary through the transferring bank on the basis of absence of document issued by Metro Dusseldorf. Therefore, 2nd beneficiary suffered from the loss of the opportunity to get a payment for their shipments made to the applicant of the credit.
In this study, the main points were focused on the liability of the transferring bank, in relation with its fault. Chinese courts expressed their opinions that the transferring bank violated UCP 500 and internationally accepted banking practices, resulting in the failure of 2nd beneficiary to deliver the complying documents and thus to obtain the payment from the issuing bank. Therefore, the judgement of the court was that the transferring bank should be responsible for the payment plus the interest thereon.
