Since the creation of incoterms by ICC 1939, this undisputed world-wide contractual standard has been regularly updated to keep pace with the development of international trade. Amendments and additions were later made in five times and presently in 2000 in order to bring the rules in line with current international trade practices. While drafting incoterms 2000, considerable effort have been made to achieve as much consistency as possible and desirable with respect to the various expressions used throughout the thirteen terms. But, Now, in incoterms 2000, FCA(Free Carrier...named point) used mainly to container cargo transport. and multimodal transport s now being Questioned.
That is, concerning export customs timing, the FCA terms be expressly stipulated in the text that "the seller delivers the goods, cleared for export, to the carrier nominated by the buyer at the named place". Henceforth, I suggest this provision should revise as follows to keep consistency in FAS and FOB terms, "The FCA term require the seller to clear the goods for export". And also, these days, international transport environment has been changed and developed rapidly based in international container cargo transport. In spite of this change, most of the contract of sale to exporting is made by FOB terms, and export declaration must be made FOB Price in Korea and Japan according to the provisions of the customs law. But there are some limitation in terms of export declaration, export statistics in which traditional FOB price is applied to the changed environment. Accordingly, I suggest the change to the FCA price instead of FOB price in the Export Declaration.
