According as the development of information technology and service industry, the change of industrial structure and the trend of labor-market's flexibility, the number of contract laborers is rising steadily. They are facing the poor working conditions and insecurity about their jobs, but yet they have not been recognised as the employee by the court and have been excluding from the legal protections because of the negative attitude of the court.
Many researchers and experts in labor law, and the labor agitators have emphasized that the legal protections and measures should be taken at their labor or service relations for one employer. For example, to impose a written contract, to protect or guarantee the payment of wages, to prohibit the unfair dismissal, to participate in the social security programs as such workmen's accident compensation insurance and employment insurance, and so on.
But it's very hard to legislate in detail for protecting the diverse working conditions of the contract laborers, because the extent of economical dependency and workings conditions are very diverse.
Consequently, the alternative measures are required that the fundamental labor rights such as the right to organize, the right to bargain collectively and the right to take concerted action should be guaranteed them constitutionally so that they should protect ourselves concretely or appropriately the working conditions and job security by the collective bargaining and agreements.
