This article gets its inspiration from Amina Lawai's case, which was finally settled in September 2003. The case had aroused global attention not only because of the inhuman judgment that was imposed on a Muslim woman-Amina, but also that the higher court of Nigeria had once justified its judgment based on their culture norms and religious customs. Throughout the world, women have been subject to immeasurable forms of abuse and discrimination, many of which are culturally and religiously based. Under international human rights law, there has long been the tension between human rights universalism and cultural relativism. This tension has the effect of dividing the international community and has served as a barrier to the promotion of universal human rights. This is especially important when we talk about women's rights, because the plight of women throughout the world has its roots deep in their respective cultures. This article examines the current international legal development and efforts taken by the international community to protect women's rights. It also explores the nature of women's rights abuses based on cultural or religious relativism. It is the author's opinion that women's rights worldwide need not be at a uniform standard. However, based on the analysis and by referencing the successful practice of several countries in reconciling this problem, the author has made suggestions on several approaches that may harmonize the conflict.
