China has become one of the centers of world business through advanced growth of economic and political status for twenty-five years. However, due to insensible development and policy only pursuing for upward growth, it is becoming a field of pollutants, As the government of China is planning to promote further development in twenty-five years, urbanization and industrialization is supposed to be promoted further. Environmental disasters caused by insensible development include exhaustion of water resources, becoming a desert, and air pollution, and if sulfer dioxide, carbon monoxide, nitrogen oxide and dust increase in the present pace, main cities of China will be polluted even enough to make breathing harder. If such insensible development plan is not amended, fatal environmental disasters will ensue. Therefore, the leaders of China are planning to correct the track with a strategy of " durable economic growth " considering environmental expenses since National Public Representative Conference of the last March.
Important legal devices that are not to be overlooked are improvement and strict implementation of the environmental impact assessment system as examined before. The 「Environmental Impact Assessment of Republic of China」 enacted on October 2002 is closer to a individual law compared to the previous law and it is considered as further advanced in that it adopts the environmental impact assessment system. However, it must be improved and complemented in that the capability of the law is not large enough to solve complex environmental problems.
As the earth is one and a permanent place to be handed down to the descendants, it should be cultivated more carefully. For this, a durable growth strategy rather than an highly-advanced growth strategy should be pursued. In this case, a legislation of a reasonable law should be accompanied to ensure the proper performance of the EIA.
This study aims to analyse the EIA based on domestic and foreign books, theses. academic journals and other data in theoretical and comparative aspects.
