This paper is to emphasize on the elementary duty of parents and the secondary duty of the country about child support after divorce, and also to suggest the plan to realize the child support. The Korean law, social service, and government policies are unconcern and irresponsible for protecting children who have lost the parents: a father who usually has the economic capacity, and a mother whom the children need extremely especially when they are young. But it is possible to protect the divorced children although social security is not as perfect as the developed countries. The country should have the guardian-like ability by emphasizing on and keeping watch over if parent execute their duty, but this can not occur through social security system. This paper also examined the foundation of law on the parents' responsibility for the child support in order to realize the child support. To emphasize on the parents' duty on support for a child, the active intervention of administrative agency about child support and the examples about the court procedure in the foreign country were introduced.
However, there is a limit where the matter on divorce and the child whose parents divorced can not be solved by the legal way. What we need in our society is to be free from the a adult-centered thought, an authoritative, patriarchal thought, a stiffly fixed idea, the notion that sees divorce as evil. To do so, the court itself should change its attitude to focus on the child's protection rather than on the adult, the parties of divorce.
