When we see the regulatory implementation of convergence between broadcasting & telecommunication, we should consider the balance between broadcasting law & telecommunication law. Furthermore, we should also take account of public law principles such as transparency and accountability. In this respect, four points need to be researched. Administrative investigation, administrative sanction, hearing and conflict resolution system.
First, administrative investigation clause of broadcasting law should take precedence over that of telecommunication law. The former provides more limited usage, hence it has less risk of infringing civil rights. For the efficiency of administrative investigation, enforcement fee should be revitalized.
Second, correction order should be used as a discretionary act in consideration of industrial and competition policy. It is not wise to uniformally limit the period in which correction order can be implemented. Penalty fee in contents regulation should be lower than that of industrial and competition regulation.
Third, broadcasting law and telecommunication law provides that when one person do not respond to hearing process, this process can be exempted. This clause should not be misused, because it tends to be infringing the people’s participatory right.
Fourth, integrated regulatory institutions should take the power of using the adjudication more widely. However, this can be criticised for infringing people’s right to take judicial lawsuit. So adjudication related process should be designed very similar to that of judicial decision.
