Along with the development of Information & Communication Technology including the mobile communication, LBS(Location Based Service) is widely spreading. Under this circumstance, each nation including Korea(the「Location Information Act」on Jan, 27, 2005) is setting legal framework to regulate Location Information Operator.
Despite various services based on location information is expected to offer benefit and risk concurrently and the「Location Information Act」will be valid in no time, the study on “Location Information Contract” is barely happened. This indicates aggressive study on “Location Information Contract” is necessary for the contracting parties to feel safe from possible risk happened from dispute.
A legal approach will minimize the risk and solve the problems followed by “Location Information Contract”
This study will analyze a concept and a feature of “Location Information Contract” and evaluate the「Location Information Act」in terms of the right and duty of the contracting parties.
Also it will point out the limitation of the「Location Information Act」and suggest several ways to improve it.
