특정한 물건이나 개인의 위치를 확인할 수 있는 측위기술의 발달로 현대인은 정확한 위치정보를 기반으로 하는 다양한 위치기반서비스를 이용할 수 있게 되었다. 예를 들면, 단순한 길찾기나 교통정보에서부터, 특정인이나 장소, 이벤트, 물류관리, 재난구조에 이르기까지 개인의 편의성 증진은 물론 신체와 재산을 보호하는 다양한 혜택을 누릴 수 있게 되었다. 그러나 이와 동시에 개인의 위치정보는 사생활의 침해는 물론 신체의 안전까지도 해할 수 있는 악용의 소지도 내포하고 있다. 이에 따라 우리나라는 2005년 위치정보법을 제정하여 사생활 침해의 가능성은 최소화하면서 위치정보를 기반으로 하는 다양한 산업의 육성을 촉진하여 왔다. 본고에서는 위치정보의 보호와 위치기반산업의 육성과 관련된 법적 쟁점을 분석 정리하고 새로운 기술환경 및 사회경제적 변화에 따른 법제도의 운영 방안에 대하여 고찰하였다.
