The Ship Investment Company Act was enacted on May, 2002, and enforced on August, 2002. Ship investment company system by this Act is that some investors in a small way invest directly into vessel, so the economical effect of this system is very great.
This study searched into establishment of the ship investment company by the Ship Investment Company Act. And this paper searched into formalities of incorporation among the lots of conditions between the Ship Investment Company Act and commercial law.
First of all, this paper study on the present state of marine transportation business, and this paper searched why introduce new system.
And then, this paper study on the formalities of incorporation comparing the Ship Investment Company Act with commercial law, like number of incorporator, subscription rates of incorporator and minimum of company's capital, etc. The focus of this comparison of both laws is centering around the Ship Investment Company Act.
The end of this paper summarized some issues and proposed improvement method of the Ship Investment Company Act to get to effect enough to the expectation from introduction of this system hereafter.
