The electronic bill of lading is to overcome the practical problems of the conventional paper bill of lading and the sea waybill. In a few models of electronic bill of lading, the most successful model is the Bolero bill of lading by the bolero.net. A Bolero Bill of Lading consists of BBL Text and Title Registry Record, and the bill may be transferred by changing the record that users have in the Title Registry Record.
The Bolero bill of lading works as of a conventional bill of lading. Bolero employs cryptography technology to provide high levels of security for all transactions. The Bolero has set up an electronic registry for bills of lading called title registry. Title registry is a database application allowing the creation and transfer of rights and obligations related to an electronic bill of lading. The relations of the users of Bolero Bill of Lading relies on the Bolero Rulebook instead of treaties and statutes.
The object of this paper is to probe this electronic bill of lading, and to accept the domestic stipulations on the electronic bill of lading which involves the Bolero Bill of Lading in Korea Commerce Code. The Korea Commerce Code has no clause on the electronic bill of lading. The electronic bill of lading should base on the electronic registry system for the negotiability, and in order to introduce the electronic bill of lading in Korea, the legal effect to electronic registry and electronic change of registry of the title registry system should be stipulated in Korea Commerce Code.
