The purpose of this study was to analyze the institutionalization possibility of fantasy sports in Korea. The fantasy sports industry has expanded rapidly in the United States. However, there is growing concern of the fantasy sports: expectations are spreading for the new economic effects of the sports industry, along with the eyes of concern over illegal gambling. Therefore, the study analyzed the legal aspects of the fantasy sports in the United States and Korea to provide legislative direction for the fantasy sports’ implementation in Korea. Firstly, the study has reviewed the laws relating to the fantasy sports in the United States: Wire Act, Professional and Amateur Sports Protection Act, The Unlawful Internet Gambling and Enforcement Act and The Illegal Gambling Business Act. In addition, in order to review the possibility of institutionalization in Korea, relevant laws such as the Sports Industry Promotion Act, the National Sports Promotion Act, the Act on the Integrated Supervision of the gambling industry, the Act on Promotion of Games Industry, the Act on Promotion of Sports Promotion, and the Act on the Restriction of Casualties were analyzed. According to the analyses, fantasy sports have some potential to be considered illegal in the domestic law. Nonetheless, it could be institutionalized along with analysis and formation of regulations on reward system and participation limit, and the controversy of an inclination to gambling could be offset by publicness to fund National Sports Promotion Funding. The possible impacts on sports related industries were discussed and implications and suggestions were presented for the future direction of the legislation and institution.
