The Korean local legislatures, which were reactivated since 1991 after having been long disorganized since 1961, has exerted many efforts for their systemic settlement on the Korean soil through the several law revisions. A stumbling block in way of the autonomy and independence of those legislatures is, however, the fact that the heads of local governments directly appoint and recruit their own staffs for the legislature's major offices. The legal grounds for this appointment is the very Article 91 of Local Autonomy Act. The paper examines both theoretically and empirically if the provision is suitable for the Constitution in terms of the division of powers and the check and balance between and among constitutional organizations. Another factor worsening the autonomy of local legislatures is the abuse of local statutes by the heads of local governments. The paper also examines how effectively local legislatures make use of their own rights to enact self-rules by the case study of three specific local legislatures--Seoul Metropolitan Legislature, Kyoungsangbukdo Provincial Legislature and Goyang City Council--, and at the same time examines these three cases in which the heads of local governments abuse their rights to enact local statutes, together with possible solutions.
