There has been much discussion with regard to the labor union system in Korea, including the twists and turns related to the labor union establishment reporting system and the guarantee of plural labor unions. The issue of guaranteeing plural unions was, however, resolved by ensuring through legislation. In addition, in the case of Korea, a company union have had a great influence on the legal principle of guaranteeing labor union activity within a business or workplace.
First, regarding the labor union establishment reporting system, there are institutional problems related to the entity that establishes the labor union. This is because a report on the establishment of a labor union by a person other than the entity establishing the labor union may be rejected by the administrative authorities. Here, an author suggests that the entity for establishing labor unions be completely open to everyone. Furthermore, I proposed introducing a procedure that requires certain qualifications to be examined in order to mediate labor disputes and apply for relief from unfair labor practices.
Next, I think the legal interpretation theory in labor relations has been developed in relation to the organizational form of labor union of a company union. Representative examples include distribution of handouts within businesses or workplaces, working hour exemption systems, and sit down strike. However, it is predicted that these traditional legal interpretation theories would require reinterpretation in relation to the guarantee of employers" property rights etc.
Finally, it should be pointed out that it is necessary to establish the relationship between representative of employees and the labor union under the Labor Standards Act and the labor-management council system, and further discuss the issue of employers" financial support for a company union and the financial independence of the labor union from an employer.
