Recently, the application of new technologies such as blockchain and AI is being sought as a way to improve the speed and efficiency of arbitration procedures. In particular, after COVID-19 in 2020, international trade parties have been improving work efficiency by communicating with counterparties and arbitrators through computer screens from time to time without space restrictions to handle dispute resolution procedures. AI e-document initiation system and algorithms that use prediction-based coding to identify, classify, and extract main contents of large-scale documents are being discussed.
In this article, I examine the applicability of AI in international commercial disputes. The structure of this article is as follows. First, the concept and characteristics of ODR and AI are overviewed. Second, the support of AI technology in the arbitration process is reviewed. The procedural features of arbitration include the process of proceeding based on the autonomy of the parties, the fairness and independence of the arbitrator, and the arbitration award by the arbitrator. Third, in order for AI arbitration to replace human arbitrators, I intend to review the legal applicability of arbitral awards focusing on the New York Convention on Recognition and Enforcement of Arbitral Awards.
