The purpose of this study is to understand the background of discussions on the pros and cods of banning imports of RealDolls, how to implement better regulations to customs laws, and further to summarize the implications of the controversy over “goods that harm public moral.”
Along with the rapid change in technology and diversification of society due to the 4th Industrial Revolution, social consensus is not easy to be achieved, and accordingly, it is becoming more frequent to dealing with goods that does not have supporting legal grounds. In the past, discussions on customs clearance for sex toys have now expanded to discussions on RealDolls, and in the future, it will extend to virtual reality (VR) devices that combine Sexbot and sex toys. Therefore, this study is not limited to the issues of banning imports of RealDolls, but is of practical importance in seeking ways to reflect social discussions on “goods that harm public moral” to Article 234 of the Customs Act. Academically, it is meaningful to expand the scope of research on customs clearance and risk management in customs administration to the level of dealing with social and ethical issues.
