Today crimes using computer device, so called cybercrime cause serious danger in our lives. However, this kind of crime is becoming increasingly intelligent that it is hard to detect only by previous detective tools. Moreover, considering that South Korea is the right place to be attacked by cybercrime due to its high informatization, we cannot delay introduction of new tools to react to these crimes effectively. In this situation utilization of spyware can be a proper solution. However, without solid confidence over national authority’s action including investigatory activities, utilization of spyware would be considered as another form of invasion of right to privacy. Thus, in order to maximize its strong points, we should devise reliable means to control of misuse of new tool. In this regard, legalization of Germany as to Online Searching can be a good reference to us. Also, we should not look over screening, selection and filtering step of information or data gathered by spyware, since in this step the most serious invasion of right to privacy could occur. For this mechanical filtering of the data by specific terms which is selected by investigatory agency.
