Recently, social media is being used as a major means of communication. The use of social media has been the subject of significant interest in the legal area. In the United States, the use of social media of lawyers increased, thus there was lots of discussion about the ethical problems. By contrast, in Korea, there is little discussion about the use of social media of lawyers. It is worth a review of the status of the United States. The reason is as follows. First, duties required of a lawyer ethics is not much different between the two countries. Second, ethical issues that may arise in the use of social media of lawyers are similar. Third, the solution of the United States can be a reference in our system. This article summarized and reviewed the following topics. First, this article summarized the lawyer’s social media usage status and the current rules applicable on the use of social media of lawyers in the United States. Second, his article reviewed several issues in the United States such as the advertisement using social media, the legal advice using social media, the social media in the discovery, the communication with the judge or the jury through the use of social media and personal use of social media. Third, this article reviewed several issues and the application of the relevant rules in Korea based on the issues of the United States, such as the advertisement using social media and dignity obligations, the legal advice using social media and confidentiality obligations, and the contact with social media.
