The purpose of this paper is to show various problems the korean Combined Broadcasting Act has from the viewpoint of legal theory in the area of administrative law and practical application and to present concrete measures for solution thereof.This study analyzes the system and legal character of the korean Broadcasting Act.The korean Broadcasting Act has many essential elements of administrative law. This is, 1) it contains administrative organization such as Broadcasting Committee, 2) administrative rule making such as the Rules of Broadcasting Committee, 3) administrative regulation such as permission of broadcasting company, 4) administrative sanction such as penalty and fine etc.This paper compares the broadcasting acts of the United States, United Kingdom, Germany, France, Japan and Korea. They have a point of sameness each other; they have the essential elements of administrative law as is in Korea.This study classifies the korean Broadcasting Act according to the system of administrative law; administrative organization, administrative rule making, administrative regulation and administrative sanction.The legal status of the Broadcasting Committee is analyzed in the section of administrative organization.This paper researches the precedents of the korean Constitutional Court about the possibility of regulation of broadcasting company such as permission and its retraction.This study deals with various problems of the administrative regulations and sanctions against the broadcasting company and makes an attempt to present concrete measures for solution there of according to the result of the researches on judicial precedents and comparative analysis.
