【Abstract】
A Legal Search on the validity of Regulations of the Holding Companies
Lee, Dong-won
This article focuses on the validity of the regulations of the holding companies in several aspects. The results of the research represent not only the problems of the regulations, but the policies on holding company. The problems of the regulations are as follow: Firstly, there is no historical origin of the legislation, secondly there are no harmonizations with the other countries containing Japan and U.S., and finally there has been set against the tendency of the U.S. Federal Cases.
Because of these reasons, many side-effects have been arisen nearly every aspects. For instance, the regulations and policies on holding company have infringed the rights of business of the company and shrinked the applications of the corporate governance. So, the author has tried to show the desirable model of the pure Fair Trading Act on holding company.
