In this study it was considered that the system of Public Participation in Criminal Trials in Korea and that in Japan are similar in several respects, as those two systems - the System of Public Participation in Criminal Trials in Korea and the Saiban-in system in which members of the general public will participate in the trial of a criminal case with judges in Japan - combine the jury system and the schöffengericht. Accordingly, the background of introduction of the system of Public Participation in Criminal Trials, the similarity and difference in two countries' systems, and the assignments afterwards were reviewed. The criminal justice system of Korea and Japan is in a period of change as it strives to be appropriate for the 21st century It seems that both the system of Lay Participation during Criminal Trials in Korea and the Saiban-in system in Japan accept the jury system in the course of selecting juries and Saiban-in but the schöffengericht related to fact finding, application of laws and ordinances, and assessment of a case. the system of Public Participation in Criminal Trials in both Korea and Japan is very unique, and especially, the rights of juries in Korea are less authorized, so it is necessary to complement and enhance this system in many respects to develop this trial system. In general, as the jury system in USA is considered as the most organized one among the system of Public Participation in Criminal Trials based on the principle of popular sovereignty, Thus, to analyze the system of Lay Participation during Criminal Trials in Korea and the Saiban-in system in Japan, and to carry out the related operation and revision afterwards, it is required to make efforts to get close to American jury system.
