China and Japan are neighboring countries. The narrow waters between the two countries are divided into territorial waters and exclusive economic waters, middle waters and common waters, etc. and It has created bilateral fisheries agreements, and fishing boats in each country are engaged in fishing in the waters designated by the fishery agreement. However, a great number of chinese fishing boats have moved beyond the fishery agreement area and have searched for a school of fish to the coast of Korea, which is relatively rich in fisheries resources. Many chinese fishing boats are engaged in illegal fishing in the Korean waters based on the Korea-China fishery agreement, exploring the Maritime Enforcement Organization(MEO)"s border activities and illegal fishing in the territorial waters.
Therefore, the MEO conduct illegal fishing, inspection and search suspicious chinese boats, illegally and violate marine boats, and MEO strongly regulate, supervise and supervise illegal fishing chinese boats.
However, there are some differences between the National Fisheries Supervision(NFS) and the Korea Coast Guard(KCG) when checking and retrieving ships and traps. This is the application of law to the illegal fishing chinese boats, the inspection and retrieval system and the corresponding procedure.
In order to solve these problems:
First, the NFS also has a judicial police right, so I would like to apply a lot of laws to the KCG. in addition, the KCG also wishes to broaden the scope of the Maritime Security Law and the application of the Fisheries Law.
Second, it is necessary to have detailed plan and trained execution instructions for various situations through integrating and revising the basic rules of inspection and search of MEO.
Third, prompt and active response procedures are required under the command of the field commander for illegal chinese fishing boats and then drastic maritime enforcement must be achieved.
Fourth, in order to monitor and supervise the wide area and numerous illegal fishing chinese boats, I think it is very necessary to provide material support such as marine police ship & fisheries control ship and personnel support to control and manage them.
Fifth, since it is necessary to improve the laws of foreign boats illegally operating again, it is urgently required to prepare legal and institutional measures with the interest and efforts of related organizations and legislatures.
