Life is a fundamental human right. The right to life is a non-derogable right that cannot be taken away and violated under any circumstance. Therefore, the death penalty is a basic violation of human rights. Migrant workers constitute one of the vulnerable groups facing death penalty. A number of countries in the world still practice capital punishment as part of their legal system. This includes several migrant worker destination countries. As the country of origin of migrant workers, Indonesia still practices the death penalty, at least for three “extraordinary” crimes, namely narcotics/drug crimes, murder, and terrorism. In Indonesia, two women migrant workers have been on the list for execution before receiving last-minute temporary reprieve. Meanwhile, there are 209 Indonesian migrant workers who are on death row abroad for various crimes such as murder, drugs, kidnapping, sorcery (black magic), adultery and the possession of weapons. This study is conducted in the framework of the National Commission on Violence against Women (Komnas Perempuan), which advocates for the abolition of the death penalty in Indonesia. This study aims to identify how the death penalty affects accused migrant workers and their families, especially in terms of creating stress, hardship, pain and the loss of economic welfare. It also explores migrant workers and their families’ access to justice and shows that the death penalty should be abolished because it targets poor and vulnerable groups such as migrant workers.
