This essay outlines the distinction of collective self and other within South Korean society by two axes of coordinates - nationality and ethnicity. Until the 1990s South Koreans assumed that their ethnic identity, nationality, and membership in society coincided with one another. In the 1990s they found this assumption shaken amidst an influx of ethnic Koreans from China and the former Soviet Union, migrant labourers from Southeast Asia, and deserters from North Korea. This in turn stimulated Koreans to reflect upon their treatment of ethnically distinct groups in their society, namely ethnic Chinese residents and offspring of mixed marriages. These groups are `otherised` by South Koreans based upon their foreign nationality, ethnic difference, or politico-social background. This study canvasses how each of these groups of outsiders has been treated in Korean law and practice. It shows the structures of the laws that give them the places they occupy in South Korean society, and demonstrates how the law has evolved in the 1990s towards accommodating them and the limitations thereof.
