Eyewitness Testimony for the Identification can be a powerful piece of evidence in a criminal prosecuation. Many people who were at one time sentenced to death have been exonerated through DNA testing, which means ‘false testimony' could cause to false and deadly conviction. I can be referred to as the “eyewitness error" what is these, hasty decision for criminal identification of witness cause of the wrong decision. The danger of error in Eyewitness Testimony for the Identification must be examined and any flawed factors in Identification must be corrected. * L.L.D. director of Korea Univ. The Supreme Court has denied reliabilty for an eyewitness and has establisched criteria for judging reliabilty by setting forth procedure for Eyewitness Testimony for the Identification due to the invalidity of procedure for criminal through photos and individual interviews that may cause unfair affect of suggestion based on sentenced 2003 D 7033 decided on Feburary 27th. 2004. Suggestions on the Implications of Eyewitness Testimony trustworthiness based on the theoretical backgrounds and case studies were discussed. In this paper, which has examined the legality of the proceeding of the criminal identified by the police investigation, and is obtained by presention a proposal to enhancing the authenticity of the Eyewitness Testimony in particular. In the future, I hope that the error judgement should be reduced by asserting in detail the results of Eyewitness Testimony for the Identification by an accurate witness, and more prudent investigation guideline must be established.
