Mobile Commerce has grown explosively based on the popularization of smart phone, and made comsumer problems. On characteristic of mobile device, it has not been sufficient to provide information of goods and services because of limited screen and some acts of deceiving consumers have been made in the area that the Act does not apply yet. Therefore, this thesis has studied what are the consumer problems in the mobile commerce, and how has the Act on the Consumer Protection in the Electronic Commerce(ACPEC) worked on these problems. And then it has searched what are the problems in applying the current Act and sought the measures of consumer protection.
Mobile commerce, in contrast with existing electronic commerce, has some characteristics such as mobility, real time, personalization, and diversification of market place. So some consumer problems that were not considered before are happened. Typical examples include difficulty to confirm the detailed information of goods or image, not providing cancellation right or refund, overcharging for billing errors, exposure of personal information, matter of security vulnerability, etc. Consumer problems can be divided into three types with these examples. These are consumer issue across electronic commerce, consumer issue in only mobile commerce, and consumer issue due to mobile device. First mobile commerce is ruled the current ACPEC because it is a kind of electronic commerce.
But there are difficulties to apply the current Act in specific application of the Act. For example, the current Act is focusing to provide information in case of insufficient information but how information is provided in mobile commerce is more important. Also, cancellation system of the current Act is based on the goods or service but is not working sufficiently for protection of comsumer in the environment based on mobile app. Similarly, the protection issue of minor because of minor’s use of smart phone is widespread, electronic commerce issue by individuals with mobile social network, privacy issue with location information due to mobility, etc. are not solved by the current Act well.
So for consumer protection of mobile commerce, a new system considering the characteristics of mobile commerce and mobile device is needed.
For this, some measures can be considered such as to establish a new legislation for consumer protection in the mobile commerce or to insert the regulations of mobile commerce as creating a new chapter in the current Act.
