The right of publicity is the inherent right of every human being to control the commercial use of his or her identity. It"s called as a right of celebrity which is often used for the protection of value of the name, image etc. of the celebrities. In Korea this right do not have any grounds in current black letter law. For this reason the recognition of this right was at debate. At this moment after the famous actress case in the year 2004 Korean lower courts recognize this right as one of the list of human rights. In nature Korean lower courts understand that this right of publicity is a sort of property right. However I think this right has still a nature of character right in its
origin. This right is a hybrid type right under the Korean legal system. Traditionally Korean courts do not allow injunctive relief on the property right in principle. However scholars mostly understand that the injunctive relief is one of the remedies for the right of publicity. Injunctive relief is very effective remedy for the protection of this right. Still under the Korean legal system it"s hard to acknowledge this injunctive relief as a remedy for the right of publicity. Rather it has to be derived from the character right in nature which will be argued and ascertained concurrently in practice. Upcoming Supreme Court decision may be awaited for the clarification of this right.
