As the era of knowledge-based economy is further advancing toward the era of creative economy, the concept of design is converted into the concept of comprehensive creation activity that improves the overall human life and expands its scope and subjects up to the value of experience and intangible factors. As the importance of intellectual property right is emphasized by restricting third party"s imitation and encouraging the creation will of creators, it is necessary to protect the right of unique, creative and intangible design. This study addressed the necessity of protecting the right of service design which is one of intangible designs. Accordingly this study investigated the meaning of service design and reviewed the diversified regulations related to design. In addition, this study investigated the cases that the market became more competitive and even saturated because some services or service designs were apt to be imitated but difficult to be protected due to the characteristic of intangible property and similar service designs from other competitors appeared. The result showed that there was enough necessity to grant exclusive rights also for service designs and the intellectual property law should rapidly cope with the trend shift of the time that the target of design is expanding.
