Anti-trust regulation on concentration of business persons in P.R.C is in its way based on anti-trust law and its subsidiary provisions of P.R.K dated on August 30, 2007. Chapter 4 regulates Mergers, and its coverage is Mergers hindering from market competition in and out of P.R.C.
On August 3, 2008 State Council of China, at the same time anti-trust law was implemented, announced "A Regulation on Standard Report of Mergers and on May 24, 2009 Anti-trust Committee explained meaning, definition, and method of the related market range. Department of Commerce is an organization which supervises a contravention of anti-trust law on Mergers in P.R.C and takes charge of disposal of concrete courses for supervision.
On June 22, 2009 Department of Commerce, for the purpose of maintaining coincidence of anti-trust law and report regulation, revised the law on reception and consolidation of native businesses by foreign investors and on July 15, revised "method of reporting Mergers and "method of examining Mergers. As for the procedure of Mergers report, the Department of Commerce regulates calculation of sales by business persons" concentration, report counselling, and supervision permission of report materials, but the latter regulates supervision procedure of business of Mergers, report cancellation, paper report and oral report, and limitation.
