The purpose of this essay is to examine the historical aspect of the separation between law and religion in the western legal history.
It has been argued that law and political power have dominated over religion in the Western history. Law and political power, however, had to have long history of conflict with religion in search of independence from Religion Power.
This process of independence is clearly illuminated under the process of secularisation in (Western) Europe identified with Christendom. The outcome of this process is the secular constitution which is considered as natural rights today.
The separation between law and religion have been significant issues related to Roman law, Canon law and Ius commnune, finally to secularism throughout the centuries.
