North Korea has revised the Law of Equity Joint Venture in order to induce the capital of foreign government and corporation. However the investment of foreign capital is not so great as expected, because the structure of the society in North Korea is too strict as is the case of the other communist nations and the social infra-structure is not yet sufficient. Moreover the Law of Equity Joint Venture have many unsatisfied contents for the foreign capitals, of which important points are as follows.
Firstly, the land cost is calculated by the authorities concerned in North Korea without model land cost, which will be one of impediment against foreign capital. So the land cost should be calculated based on international standard and the government in North Korea should make out model land cost.
Secondly, the Law of Equity Joint Venture has unanimous rule in the board meeting, which will be an obstacle to make out better solution in difficult decision making. Therefore the Law should be evised, to introduce the rule of majority or weighted majority.
Thirdly, the Joint Venture should employ residents of North Korea through authorities concerned with strong labor union. This labor system in North Korea is not also advisable for the inducement of foreing capitals. So labor system corresponding international standard should be introduced in North Korea.
Fourthly, according to the law of joint venture in North Korea, the disputes between the joint venture and government or third party would be settled by the domestic law in North Korea. This dispute system will be unsatisfactory to foreign partners, whereby international dispute system should be introduced in North Korea.
