North Korea's legal system of foreign investment consists of mainly the Law of Foreign Investment, the Law on Equity Joint Ventures, the Law on Contractual Joint Ventures, and the Law on Wholly Foreign-Owned Enterprises. The Law of Foreign Investment is the primary and general law, which regulates all foreign investment in North Korea. The other three laws are individual laws which regulate each of three types of foreign investment in North Korea: equity joint ventures, contractual joint ventures, and wholly foreign-owned enterprises.
These laws on foreign investment control all foreign investment activity in North Korea and provide the basic rules and principles for the establishment and operation of the above three types of enterprises which are founded by foreign investors.
Equity joint ventures can be defined as an enterprise which the North Korean and foreign investors jointly invest, operate together, and share profits according to the amount of respective investment. Contractual joint ventures refer to those in which the North Korean and foreign partners jointly invest, but are operated solely by the North Korean Partner. These two types of enterprises can be established anywhere throughout North Korea. While wholly foreign-owned enterprises are exclusively founded and managed by the foreign investor and must be established and operated within the confines of an Free Economic and Trade Zone.
The Investment in North Korea will offer lucrative opportunities for South Korean Enterprises. Moreover, the Promotion of the economic cooperation between South and North Korean would be the most effective way for reunification of the two Koreas. Accordingly, it is very important for us to study closely the legal system of the foreign investment in North Korea.
