Under the current public announcement system of ships, a ship must go through two separate registration systems: registration with the Supreme Court as well as the Ministry of Land, Transport and Maritime Affairs (the “MLTM”). The registration with MLTM manages essential basic data and information of ships (i.e., nationality or tonnage of the ships) to supervise maritime affairs. On the other hand, the registration with the Supreme Court deals with the property rights for the ships, such as ship ownership or ship mortgages to protect the rights over ships and promote safe ship transactions. Even though each system has its own purposes and merits, empirical data shows that these systems inevitably have duplicate aspects and impose more than optimal costs on ship owners. It is also argued that operating two systems squander the nation’s resources.
In this regard, this paper is searching for a better public announcement system for ships. The public announcement system is a matter of legislation policy. Thus, either a dual registration system or a single registration system can be selected but convenience and efficiency of operating a system must be taken into account. From the perspectives of convenience and efficiency, the current dual registration system is not a desirable form and needs to be changed into a single registration system to reduce social costs and expedite ship transactions. For example, a car or an airplane, which is legally considered as movable property similar to ships, has a single registration system with MLTM, which includes basic information of each asset as well as the property rights over them. In addition, UK or the U.S. operates a single registration system of ships.
Given that, it will be desirable if the current dual registration system is changed into a single registration system with MLTM. It will improve efficiency in ship operation as well as ship transactions.
