This Article is designed to establish the blueprint of the Association of Content Property for Next Generation. At the outset, the title of the association need to be explained.
The term, 'next generation', refers to a future-oriented concept in that the development of technology and science has resulted in a market for a new content and thus the necessity for being supported by the policy and laws, and in that, in tum, the reform of laws and policy change can lead to a market for a new content and encourage the technological development, advancement of science, and social change.
The term, 'contents', is widely used by practitioners, scholars, government officials, and businesses. However, the terms, 'content' rather than 'contents', and 'content industry' rather than 'contents industry', are preferably used in common law countries.
According to Article 2(1)(1) of Content Industry Promotion Act, the term, 'contents' is defined as "data or information expressed in codes, characters, color, voices, sounds, images or pictures, and a combination thereof etc."
Those contents are not always protected by the laws. Policymakers need to determine whether they are protectible by the laws whenever a market for a new content is created and how to protect them. In this regard, the policymakers need to decide whether they will protect those contents based on property rules or liability rules.
For the perspective mentioned above, this Article will explore the definition of the content, the laws governing the content industry, the literature and the case law related to the content industry, the economic analysis of the content industry, and, in particular, the digital content.
