In the last decade, stalking has emerged as a significant social problem. It occurs when one individual repeatedly attempts to impose on another unwanted contacts and/or communications. Legislators have broadly defined the offence as 2 or more such intrusions that are intended to, or actually, render the recipient fearful. At the time Anti-Stalking Law 1998 in Korea were also drafted, little was known about victims of this offense or nature of the offence itself. At that time, much of the information available concerning stalking victims was predominately anecdotal and frequently derived from popular media. At a population level, however, insufficient is known about the prevalence and nature of stalking.
The purpose of this article is to empirically examine the phenomenon and nature of stalking and its victims. This paper defines stalking as experiences of persistent and unwanted attention. It presents the findings from an innovative self-completion questionnaire included in the 2000 stalking victim survey designed to provide the first reliable measure of the extent of 'stalking' in Metropolitan Area, and in the 2002 three vulnerable groups(a random sample of college student, a random sample of celebrities in popular media, and domestic violence victims in shelters) to be more likely to be victimized. It also identifies those most at risk and what types of behavior victims are subjected to. The results will be of great interest to researchers and practitioners alike. This research contributes that it seeks to empirically validate many of the elements that legislatures have utilized to define the stalking event as a crime. Further, this article explores the role that law can playing in combating stalking behavior and suggests several remedies-criminal law and other remedies (both of legal and non-legal nature)- might play in cases of stalking.
