In the Spring of 2000, the Banking Commission of the ICC decided to appoint a working group to create an addendum to the UCP to clarify the position with regard to the electronic presentation of document equivalents under a documentary credit.
By a lopsided vote of 63-3, the ICC Banking Commission, meeting in Frankfurt, has approved an electronic supplement to the UCP. The vote came on a final working party draft that was the culmination of 18 months of work by the Commission. Called the eUCP for short, the electronic supplement to UCP 500 was written to take account of the increasing number of documents being presented electronically.
This eUCP will become effective as from midnight GMT on 31 March 2002 to govern electronic letter of credit presentations.
Bankers and traders who are engaged in electronic commerce must understand the implications of the new eUCP Articles to protect their interest and to avoid risk and disputes.
So, this article covers the background, purpose of the eUCP Version 1.0, the nature and scope of application of the eUCP, the relationship of the eUCP to the UCP 500, Electronic presentations, Examination of electronic records and refusal notices.
Firstly, eUCP stands for "Supplement to UCP for Electronic Presentation", so Parties concerned in credit transactions do not forget that eUCP is supplement for UCP, not replacement.
Second, eUCP does not address issues relating to the issuance or advice of credit electronically but address issues relating to the presentation of the elctronic record or mixture of electronic record and paper document. Hence, eUCP do not apply in circumstances which beneficiary would present only paper documents.
Third, eUCP credit beneficiary must provide the bank which presenation is given with notice of presentation completenes, or bank can regard this presentation as not being presented.
Fourthly, banks have the reasonable time not exceeding five banking days if beneficiary presents only electronic record. This, I think, is major thing to be remembered.
