Incoterms have been revised in line with the latest changes in prevailing international trade practice and entered into force from Jan. 1, 2000. It consists of a set of 13 international standard trade terms, Incoterms mean the ICC official rules for the interpretation of trade terms which facilitate the conduct of international trade. The applicational scope of Incoterms is limited to the contract of sale except applying to the contracys of carriage, insurance and financing.
The purpose of this paper is to examine the main features and its problems in the practical application of Incoterms 2000. As a result of examination, it is particularly important to note that Incoterms are not dealt with a number of problems, such as transfer of property rights, breaches of contract and exemptions from liabilities and so on. Therefore, the contracting parties concerned should clearly agree to the applicable rules related their contract of sale like the UN Convention on CISG, 1980.
