European Union(EU)'s 'Trade Barrier Regulation'(TBR), the new external trade regulation of substitution for the past 'New Commercial Policy Instrument' (NIPC), contains more effective and prompt countermeasures for international trade. This new trade regulation, in particular, provides not only EU's preferential observance of international trade dispute settlement procedures but also market-opening pressure measures against out of regional countries' illegal trade policy. Accordingly, we need to make a close investigation and analysis of newly adopted EU's 'Trade Barrier Regulation'(TBR) to examine reinforced provisions and measures, consider appropriate measures and prevent trade dispute and conflict with EU countries.
The 'Trade Barrier Regulation'(TBR) based on the past 'New Commercial Policy Instrument'(NIPC), as stated above, adopts aggressive and active political measures. For instance, in collaboration with WTO regulation, it extends the measures' limit of application to almost fields of economic activities such as service, intellectual property, etc. as well as eases litigation condition. Furthermore, major changes which the new adopted trade regulation shows are to recognize locus standi of EU countries' private enterprises and reinforce countermeasures against out of regional countries' illegal trade practice. Therefore, it should be noted that the EU's 'Trade Barrier Regulation'(TBR) will be more strong trade protections in that it will try to remove trade barriers and more protect EU countries' industries.
This paper researches newly adopted provisions and political measures in 'Trade Barrier Regulation'(TBR) in comparison with the past 'New Commercial Policy Instrument' (NIPC). It also contrasts them with the US Section 301 of the Trade Act to find the differences between the two. Finally, this paper studies dispute settlement cases to which the 'Trade Barrier Regulation'(TBR) have practically applied. In conclusion, the author, by these studies, hope that we can more clearly understand implications for Korea in establishing and enforcing reasonable and effective trade policy toward EU.
