Considering the rapid advent of aging society and the severity of the problems of the aged, the role and obligation of local governments which should solve the problems of the aged as main administrative subjects are extremely important.
But, most of local governments which lack the capital strength, specificity and technology can not produce and supply the sufficient welfare services for the aged.
Meanwhile, under the present circumstances of deregulation, public-private cooperation, the expansive application of market system to modern administrative process, Contracting-out of welfare affairs can be a good method of administration.
Nevertheless, the system of Contracting-out is not satisfactorily established yet in principle and legislative system in our country.
In this point of view, I have researched the present situation of Contracting-out of welfare affairs of the aged in local government and studied some important issues of law such as the standard(the scope of administrative affairs), process, contract, legal effect, dispute settlement about Contracting-out of welfare affairs of the aged in the aspects of principle and legislative system of a constitutional state.
