Land rights have dual-sides of interests, i.e., individual interests and public interests. These interests are often confronted with each other. And land laws basically are to coordinate these conflicts. This paper is to review the dual-sides of land rights and to suggest the future directions of land laws to mitigate the landed conflicts.
The individual interests of landownership have rooted in the belief of so-called the sacred and inviolable property ownership, which were claimed in the French Declaration of Human Rights in 1789. Landownership had been regarded as one of the sacred and inviolable rights. This concept had been the cornerstone of the modern ownership, which have been reflected in the Constitution and Civil Law in most countries. Landownership, thus, have been accepted as a bundle of rights to pursue the whole interests in using, renting and disposing activities.
As modem society evolved, this concept of the sacred and inviolable landownership had been changed gradually. The ideas that ownership of landed property have to serve the increment of public welfare have spreaded widely. The tenet of the Germany's Weimar Constitution in 1919 have influenced the ideology of many other countries' Constitution, i.e., to protect private ownership and also to promote public interests. Many public burdens have been levied upon the landowners in order to increase the welfare of the whole society.
In fact land is naturally given to the whole society. Land has many unique characteristics which makes land different from other properties. It requires more publicity for the welfare of the whole society. Individual interests of landowner are restricted by land laws which impose of many regulations on the landowner. Conflicts between individual and public interests embedded in landownership are getting severe.
The urgent tasks in these days are how to harmonize these conflicts, i.e., how to coordinate the dual functions of protecting private interests in the one hand and increasing social welfare in the other. Land laws need to emphasize the publicity of land. Nevertheless, even if infringement on private ownership is inevitable for the public welfare, adequate rescue or compensation should be made, too.
